1. Acceptance of Terms
By downloading, installing, registering or using the Merkurio mobile application (hereinafter ‘the Application’ or ‘the Service’), you (hereinafter ‘the User’) agree to be bound by these Terms and Conditions of Use (hereinafter ‘the Terms’).
If you do not agree to these Terms, you must refrain from using the Application. Continued use of the Application constitutes acceptance of the current Terms.
2. Service Description
Merkurio is a mobile point of sale (POS) application designed for small and medium-sized businesses. The Service allows users to:
- Register and manage sales of products and services
- Manage inventory and product catalog
- Manage multiple stores or branches from a single account
- Create and manage users with different roles (owner, administrator, cashier, etc.)
- Manage customers with credit, payments and debt tracking
- Register suppliers and contact information
- Control work shifts and cash register reports
- Register returns and business expenses
- Operate in offline mode and synchronize data in the cloud
3. Registration and User Account
3.1 Registration Requirements
To use Merkurio you must create an account by providing truthful, current and complete information. You are responsible for:
- Providing accurate data at the time of registration
- Maintaining the confidentiality of your access credentials
- Immediately notifying of any unauthorized use of your account
- All activities performed under your account
3.2 Employee Accounts
As the account holder, you can create sub-accounts for employees (cashiers, administrators, etc.). You are responsible for the use that these employees make of the Application, for having their consent to register their data, and for properly managing their permissions.
3.3 Minimum Age
The Application is intended exclusively for persons over 18 years of age with legal capacity to enter into contracts. By registering, you declare that you meet this requirement.
4. Subscription and Payments
4.1 Payment Model
Merkurio operates under a subscription model. Payment is managed exclusively through:
- Google Play Store (Android devices)
- Apple App Store (iOS devices)
Merkurio does not store or directly process credit card data or other payment methods. All financial transactions are managed by the respective distribution platforms according to their own terms of service.
4.2 Renewal and Cancellation
Subscriptions renew automatically according to the contracted period. To cancel your subscription, you must do so directly from your account settings in Google Play or App Store before the end of the current period. No refunds are made for unused periods except as established by each platform’s policies.
4.3 Price Changes
Merkurio reserves the right to modify the prices of its plans. Changes will be notified with at least 30 days in advance and will not affect the current subscription period.
5. Acceptable Use of the Application
5.1 Permitted Uses
The Application is designed for legitimate commercial use. You commit to using it exclusively for:
- Internal management of your business or company
- Registration of your own sales, inventory and commercial operations
- Administration of your work team
5.2 Prohibited Uses
It is strictly prohibited to:
- Use the Application for illegal, fraudulent activities or activities that violate third-party rights
- Attempt to access systems, data or accounts without authorization
- Copy, modify, decompile, reverse engineer or distribute the software
- Register data from third parties without their consent
- Use the Application to process transactions of illicit nature
- Impersonate identities or provide false information
- Interfere with the normal functioning of the platform
6. Responsibility for Customer and Supplier Data
When using Merkurio, you may enter personal data of your customers and suppliers (names, phones, emails, addresses, credit information, etc.). In this case:
- You act as the data controller for such personal data
- It is your obligation to have the consent of the owners for their registration and use
- You must inform your customers and suppliers about the processing of their data
- Merkurio acts as the data processor, processing such data only according to your instructions
Merkurio is not responsible for the improper use that the User makes of third-party data registered on the platform.
7. Intellectual Property
The Merkurio Application, including its source code, design, logos, names, trademarks, texts and user interface, are the property of Merkurio and are protected by intellectual property laws applicable in Mexico.
These Terms grant you a limited, non-exclusive, non-transferable and revocable license to use the Application exclusively for the purposes described. No provision of these Terms transfers ownership rights over the Application.
8. Service Availability and Modifications
8.1 Availability
Merkurio strives to maintain service availability, however does not guarantee uninterrupted availability. The service may be affected by:
- Scheduled or emergency maintenance
- Technical failures of third-party providers (Google Firebase, etc.)
- Force majeure causes
8.2 Service Modifications
Merkurio reserves the right to modify, suspend or discontinue any function of the Application at any time, with or without prior notice. We will not be liable to you or third parties for such modifications.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Merkurio and its legal representative will not be liable for:
- Loss of data due to technical failures, connection or improper use of the device
- Indirect, incidental or consequential damages arising from the use or inability to use the service
- Errors in data synchronization in offline/online mode
- Acts or omissions of third-party providers (Firebase, Google Play, App Store)
- Unauthorized use of the User’s account by employees or other persons
The total liability of Merkurio, in any case, will be limited to the amount paid by the User in the last 3 months of subscription.
10. Privacy and Data Protection
The processing of your personal data is governed by Merkurio’s Privacy Policy, available at:

The Privacy Policy is an integral part of these Terms and Conditions.
11. Service Termination
Merkurio may suspend or cancel your access to the Service in case of:
- Breach of these Terms
- Non-payment of subscription
- Fraudulent or illegal use of the service
- Express request from the User themselves
Upon termination, your data will remain stored for a period of 30 natural days, after which they may be permanently deleted. The User may request the export of their data before this period by writing to contacto@mercuriomx.com.
12. Applicable Law and Jurisdiction
These Terms are governed by the laws of the United Mexican States. For any controversy arising from their interpretation or compliance, the parties submit to the jurisdiction of the competent courts of the State of Aguascalientes, Mexico, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
13. Modifications to the Terms
Merkurio reserves the right to modify these Terms at any time. Modifications will take effect from their publication on the website. Active users will be notified by email or notice within the Application. Continued use of the Service after publication of changes implies acceptance of the new Terms.
